The websites located at Lightspeedvoice.com and Lightspeedsolutions.net (“Websites”) and our business use services (“Services”) designated and marketed as Lightspeed Voice and Lightspeed Solutions are operated by Lightspeed CLEC, Inc., a Florida corporation ("Lightspeed" or “we” or “our”). Lightspeed wants to make your online website experiences and the use of our Services positive, convenient and safe. Your privacy is very important to us.
This privacy policy (“Privacy Policy”) describes the information that we collect, share, store and release about you and how we use this information. It also describes options that may be available to you regarding use, access, deletion, and correction of your information. Lightspeed uses your information for the purpose of providing our Services to you, for the benefit of you. Lightspeed does not sell or monetize your information to third parties. A reference in this Privacy Policy to "you" or "your" means you, the individual visitor to the Website and user of the Services.
Please note that our Websites and Services are only available to those located within the United States of America or specifically stated in your Agreement. We make no representations, warranties, or guarantees concerning the suitability or legality of these Websites or the Services in any other country. Any access to these Websites or Services from outside of the United States of America is entirely at your own risk.
The names of our service offerings have changed over time. Our previous PrismPBX® offering is now known as Connect while our Follow-Up Tool® offering is now known as Automate. We also offer a service that combines both the Connect and Automate offerings into a single offering called Quantum.
Lightspeed does make use of third-party providers. Third parties allow us to provide specific offerings and integrations, in addition helps optimize your interactions and Services with us. Any information shared is solely for legitimate business or legal purposes for you to use our Services.
Our primary goal in collecting information from you is to provide you with best-in-class experience while you use our Websites and Services. We also collect information so that we can market our Services, provide you quotes, respond to your inquiries, allow access to our Services, enhance our current functionality, facilitate your relationship with Lightspeed and to comply with applicable laws. The information that we collect on the Websites and in connection with your use of the Services depends upon your use of the Websites and Services as detailed more fully in this Privacy Policy.
We also collect information from internet cookies, which is addressed more fully in the section below on Internet Cookies.
We use the information we collect from you when you contact us with a comment or question via the Contact form on our Websites or by telephone, to respond to your specific inquiry. If you choose to enroll to receive email updates about Lightspeed's offerings, we use your email address to send you those email communications.
If you contact us either by telephone or through the Websites to purchase Lightspeed Services, we use the Initial Registration Information and Billing Information that we collect to create your account with Lightspeed. This information is also entered into our CRM database, which we use for account administration, customer support, marketing and advertising purposes, including sending you email communications about products and services from Lightspeed, which may be of interest to you. For additional details about how Lightspeed uses your information, please consult the “Lightspeed Accounts and Licenses” section below.
We use your username and password information to authenticate your credentials when you log into our Websites and Services to use Lightspeed. If you forget your password, we will use the email address that we collect to locate your account and to generate an email with instructions on how to reset your existing password.
In the event that you contact us for a demo of any Lightspeed offering, we will use the information you provide to arrange your demonstration. We will also add this information to our CRM system, which we utilize for advertising and marketing purposes, including sending you emails about our products and services.
If you choose to utilize any of the third-party integrations that we offer with CRM platforms, and desire to have certain information stored in a CRM platform, we will use your Call Information to carry out this task. We use your App Information to carry out your request, if you choose to upload MMS messages to a CRM platform, or to initiate calls and text messages from your local phone contacts, or to upload your phone contacts to a CRM platform. Your CRM Information is utilized to the extent you choose to have CRM contacts populate in your Lightspeed mobile application.
When you choose to submit an image of an issue to our support team, we use your Troubleshooting Information to respond to your issue and to administer technical support.
We utilize internet cookies on our Websites, including first party cookies, which are cookies deployed by us, and third-party cookies that are deployed by third-party service providers. Cookies are small files that are transferred to your computer’s hard drive through your web browser to enable us or our service providers to collect information about you. We use cookies to collect information such as your IP address, computing device type, operating system type, internet web browser name, web browser language setting, web history, geographic location (based on IP address), and other usage information regarding your use of our Websites.
We use the information we collect from cookies to recognize you when you return to our Websites as someone who has visited the Websites previously. This enables us to provide you with a more personalized experience while you browse our Websites. We use cookie and web beacon technology to track which pages on our Websites our visitors most often view to help us identify the functionality, features, and content, which is most popular among our users. This information also helps us understand the computing devices and browsers that most frequently visit our Websites, which helps us to optimize the Websites for those devices and web browser types. We use third party analytics providers and an ad network, which tracks your online activities over time while you access third party websites, which is obtained through automated means. Most Internet browsers permit you to erase or block cookies. If you configure your browser to remove or reject cookies, though, you will not be able to enjoy the full functionality of our Websites.

In connection with providing you with the Websites and Services, we utilize a number of third-party service providers. These third-party service providers provide us with services such as web and data hosting, artificial intelligence (“AI”) services or other similar technology, CRM integrations, email, software, managed services, faxing, web design and maintenance, advertising, marketing, telecommunications, and logistics services. In each case, our contracts with these third parties prevents their usage of any of your personal information, such as your name, email address, phone number, metadata, transcripts, summaries, sentiments, recordings and documents for any purposes other than to provide their services to us.
We also utilize a third-party service provider for analytics services, as described in the section above concerning "Internet Cookies."
On rare occasions, we may be required to disclose your information, as determined in our sole discretion, to comply with a legal obligation imposed on us, or as required by law pursuant to lawful requests such as in compliance with a subpoena, court or agency orders. We reserve the right to cooperate with law enforcement in connection with any investigation into any illegal, malicious, or fraudulent activity concerning our Websites or the Services. We will also disclose your information, as we may reasonably determine to be necessary to protect our rights or the rights of others, to avert harm to persons or property, or to enforce this Privacy Policy.
In the event that Lightspeed, or substantially all of Lightspeed's assets are sold to a third party, or Lightspeed reorganizes, or merges into another entity, the information we maintain about you, including your personal information, will be among the assets transferred in connection with any such transaction with the acquiring or merging entity.
Lightspeed retains information for varying lengths depending on the type of information collected and the purpose for which it is collected. At a minimum, Lightspeed keeps information for as long as it is required to do so by law, or it has a legitimate business interest in doing so. Where we have no ongoing legitimate business needs to process your personal information, we will delete or anonymize it.
Lightspeed uses commercially reasonable security measures to protect the privacy of your personal information. However, transmissions over the Internet are not completely secure, and any information you send to or through our Websites and the Services may be accessible by others. Lightspeed cannot guarantee our security measures. To the extent you have a user account with us, which is accessible online, you are responsible for maintaining the secrecy of your username, password, and any account information. Do not share your username or password with any other parties. At the conclusion of your browsing session, make sure to sign-off to render the account inaccessible to other users. In the event that you discover any unauthorized access to or use of your username and password, you must immediately notify us of the breach.
We are concerned about the safety of children when they use the Internet and will never knowingly request personally identifiable information from anyone under the age of 13. Users of our Websites and the Services must be at least 18 years old. If you are under 18 years of age, you must immediately terminate your use of the Websites and Services. Furthermore, if you are under 13 years old, you should not provide any information to us. If you are a parent or legal guardian of a child that has provided us with personal information, you should immediately contact us (see below) to have such information deleted from our records.
In order to establish an account or license for Lightspeed, we will collect your Initial Registration Information dependent on Services selected such as, Billing Information, your company name, the first and last name of the person establishing the account, that person's email address, a username, password, current carrier or provider, phone numbers and devices you wish to migrate over. For each telephone or device user that you wish to establish under Lightspeed, we will collect the user's name, email address, the applicable phone number or device for that user that is being transferred to us and applicable user's cell phone number, which is optional, depending upon the service features that a given user would like to utilize. This information is used to set up each user's account.
Lightspeed includes a number of features, which you have the option to utilize, including the capability for you and your users to obtain reports of calls, monitoring of devices, transcriptions, sentiments, summaries, logs, to send and receive text messages, and to record interactions such as calls, texts, and chat conversations.
You will also be asked for information to create any user accounts for any of your employees whom you may wish to grant access to use Lightspeed. The information that we collect to establish a user account includes first and last name, phone number, address, email address, phone number, device, username, and password ("User Account Information"). We use the User Account Information that we collect for each user account to register and provide each applicable user with access to Lightspeed.
From within Lightspeed, you and each of their users are permitted to input information about your clients or prospective clients. Lightspeed maintains the information that you and your users input into the system as a database. Lightspeed also includes customization features, which enable you to customize the fields of information that you desire to collect. For example, you might choose to store information about a current or prospective client including the client's name, address, email address, telephone number, interactions with that particular client or prospective client, and any other related or relevant information that is permitted under the terms and conditions applicable to Lightspeed. Please be advised that our terms and conditions for Lightspeed prohibit you from using Lightspeed to store sensitive information.
We ask that you not send us, and you not disclose, any sensitive personal information (e.g., information related to racial or ethnic origin, political opinions, religion or other beliefs, health or medical condition or criminal background) on or through the Websites or otherwise.
Lightspeed as an interconnected VoIP service provider is regulated under Title 47 of the United States Code, as amended by the Telecommunications Act of 1996, for protecting CPNI of its users regarding telecommunication services.
CPNI includes specific data collected by Lightspeed such as the time, date, duration and destination number of each call (inbound and outbound), the type, term and price of Services you subscribe to, your devices, internet connections, operating system and software information, and other information that may appear on your Lightspeed invoice. CPNI does not include your basic contact information (such as name, phone number, and address).
Lightspeed protects CPNI while providing telecommunications services. We use this information for several purposes, including billing and administrative purposes, to prevent fraud and abuse of our Services, to provide call location information for public safety and in the provision of emergency services, under legal process (ie. subpoena, warrant, court order) or to offer personalized offers and services (see below), which you may find valuable in compliance with CPNI requirements.
You have a right, and Lightspeed has a duty, under federal law, to protect the confidentiality of CPNI. Lightspeed personnel are not permitted to access, use, or share any CPNI unless they are authorized and have a legitimate business need to do so.
Lightspeed may use CPNI to market other Lightspeed category of services (known as adjunct to basic services) as this does not require opt-in consent from you. If Lightspeed markets outside of those categories already purchased, then Lightspeed will only use subscriber list information; it will not use your CPNI. You, however, have the right to opt-out of Lightspeed’s use of CPNI for marketing services. The decision to opt-out will not affect your Lightspeed Services; however, your consent may enhance Lightspeed’s ability to offer products and services tailored to your needs. If you wish to opt-out from receiving other Lightspeed marketing services based on our use of your CPNI, you can do so at any time by notifying Lightspeed using the “Contact Us” information below. If you do not opt-out, your consent will remain valid until you tell us otherwise.
Lightspeed additionally uses agents or partners authorized under contract to assist initiating, rendering, billing and collecting for services it provides to its customers. Those agents or partners are contractually bound to utilize CPNI only for these purposes and may do so without receiving opt-in consent.
Lightspeed will provide CPNI to any person designated by an authorized user of customer upon receipt of an affirmative written request of customer.
If Lightspeed believes or determines that you have violated Lightspeed’s Terms of Service (available on our Websites) or any other Lightspeed terms or law regarding prevention of fraudulent, abusive, or unlawful use of Lightspeed’s Services, the Lightspeed will use and disclose CPNI to the extent necessary to protect itself, users of Lightspeed’s Services, and other carriers from further fraudulent, abusive, or unlawful actions.
In event of a CPNI breach, Lightspeed will notify the United States Secret Service (“USSS”), and the Federal Bureau of Investigation (“FBI”) as soon as practicable, but in no event later than seven business days, after a reasonable determination has been made that a breach of a customer’s CPNI has occurred. Lightspeed will notify its affected customers without unreasonable delay after Lightspeed has completed the process of notifying law enforcement unless extraordinary circumstances require earlier notification to prevent immediate and irreparable harm and the relevant investigating agency agrees with such earlier notification. Lightspeed’s notification to its customer will include sufficient information to make a reasonable customer aware that a breach occurred on a certain date or within a certain estimated timeframe and that such a breach affected or may have affected that customer’s data, to the extent Lightspeed has this information. If the relevant agency investigating a breach determines that public disclosure or notice to customers would impede or compromise an ongoing or potential criminal investigation or national security, Lightspeed will delay its notification to the affected customers until the investigating agency permits public disclosure or notice to its customers.
We do not currently honor or otherwise recognize "Do Not Track" signals or requests from internet web browsers, primarily because there is no universal standard regarding such requests.
Lightspeed reserves the right to make periodic changes to this Privacy Policy, and we will post the changes on the Websites, which will become effective upon posting. It is your responsibility to regularly check this webpage and the Websites for changes. Please take a look at the “Last Updated” legend at the top of this page to see when this Privacy Policy was last revised. In the event we make a material change regarding our privacy practices, we will post notice of such changes on the main page of the Websites. In all cases, your continued use of our Websites will constitute your acceptance of any such amendment.
To review, correct, update, suppress, delete, or otherwise limit our use of your personal information, such as your name, email address, telephone number, or other similar information that you have provided us, please email, call, or write us using the contact information listed below in the “Contact Us” section and clearly describe your request. In your request, please make clear what information you would like to have changed, or whether you would like to have your personal information suppressed from our database. You may also ask us to remove you from our email mailing list. We will take reasonable efforts to comply with your request as soon as it is reasonably practicable. Note that despite our efforts, there may be residual information that will remain within our databases and other records that will not be removed or changed.
